Board of Zoning Appeals to consider several sets of variance requests

Bethany Bend rendering home renovationMilton’s Board of Zoning Appeals will consider several sets of variance requests for different properties when it convenes Tuesday evening.

The meeting of this committee, also known as BZA, will begin at 6 p.m. on August 20 in City Hall’s Council Chambers. People can watch online at https://www.youtube.com/watch?v=83Sx0zPMBUc or attend in-person.

The BZA is a quasi-judicial body that hears requests for variances from the City Code as well as appeals to City decisions related to zoning ordinances, stream buffers, and sign permits. Its members’ votes are guided by City Code, including its zoning standards. BZA decisions can be appealed to Fulton County Superior Court.

Below are summaries of each item on Tuesday's agenda, including the requested primary variances: 

  1. 2390 BETHANY BEND, a nearly 4-acre lot between the Hopewell roundabout and Bethany Church Road, with the applicant requesting variances to:
    • Allow an existing concrete patio, accessory structures, and driveway to remain inside of the 50-foot undisturbed stream buffer
    • Allow a new single-family home renovation and wing wall to encroach into the 75-foot impervious setback, as well as for an existing concrete patio, driveway, and accessory structure to remain inside of the 75-foot impervious setback
    • Allow – as part of the aforementioned home renovation – to reduce the minimum side-yard setback adjacent to the east property line to 17.7 feet (down from 25 feet) and the minimum rear-yard setback adjacent to the north property line to 43.1 feet (down from 50 feet)
    • Allow an existing accessory structure to remain in front of the proposed single-family home
    • Allow a swimming pool in what would be considered the property’s front yard

       

  2. WITHDRAWAL REQUEST for 980 BIRMINGHAM ROAD, home of the commercial complex known as Birmingham Village that contains the Baby Publix and other businesses. The applicant had been looking for variances related to the replacement of two signs. But now they plan to ask that these be withdrawn; BZA is set Freemanville proposed platto vote on accepting this withdrawal request at Tuesday’s meeting.

     

  3. 12500 WATERS EDGE DRIVE, which is not far from Hopewell Road. The owner of that 1.08-acre parcel is seeking a variance to:
    • Reduce the rural viewshed setback requirement from 20 feet down to 9.1 feet (along the west property line, which happens to be Hopewell Road) for existing pool house

       

  4. 14880 FREEMANVILLE ROAD, between Rolling Links Drive and Deerhaven Lane, where two parcels will be combined to create a single 7.02-acre lot. The applicant is requesting variances to:
  • Allow an existing run-in shed (along the south property line) to be in front of a proposed single-family home
  • Allow an existing shed (along the east property line) to be in front of a proposed single-family home
  • Allow an existing 1-story accessory structure (along the east property line) to be in front of a proposed single-family home
  • Allow a proposed guesthouse to be in the property’s side yard
  • Allow a proposed swimming pool to be in what’s considered the property’s front yard

 

After this meeting, Milton’s Board of Zoning Appeals is next scheduled to convene on September 17.
