BZA to consider an appeal related to a Bethany Bend property

Commonly referred to as BZA, this committee is a quasi-judicial body that hears requests for variances from the City Code as well as appeals to certain City decisions including those related to zoning ordinances, stream buffers, and sign permits. Its members’ votes are guided by City Code, including its zoning standards. BZA decisions can be appealed to Fulton County Superior Court.

Tuesday’s agenda contains a single item pertaining to 2335 Bethany Bend, a 1.52-acre lot not far from the Hopewell Road roundabout. The applicant, who resides off of Hopewell Road, is seeking a Secondary Variance request. Specific to the 2335 Bethany Bend property, the applicant is challenging the Community Development Director’s interpretations regarding:

  • Retaining wall requirements
  • Public notification requirements for subdivisions
  • Demolition permit requirements
  • Public notification requirements for demolition approvals reviewed by the City of Milton Design Review Board

After this meeting, the Board of Zoning Appeals is next set to convene on October 15.
