Council to start 2025 with DRB appointment, Mayor Pro Tem selection

Attentive Listening CouncilCity Council will kick off the year Monday with its annual selection of a Mayor Pro Tempore as well as welcoming the newest member of Milton’s Design Review Board.

The January 6 meeting will begin at 6 p.m. in City Hall’s Council Chambers at 2006 Heritage Walk. People can attend in-person or watch the meeting online at https://www.youtube.com/watch?v=i_1HHEmqaOA.

As is customary, the agenda for this Regular Meeting is divided into sections that each have their own ground rules. For this meeting, they are:

  • The CONSENT AGENDA, which consists of routine items that are considered collectively – so one vote that covers all included items
  • REPORTS AND PRESENTATIONS, the place for proclamations, presentations, and reports during which the Council may ask questions or offer direction but cannot cast votes
  • FIRST PRESENTATION, the home for certain types of items appearing on an agenda for the first time that cannot be voted on conclusively until a future meeting
  • NEW BUSINESS, which is where you’ll find items that are on an agenda for the first time that can be discussed and decisively voted on

Below are summaries of every item on the January 6 agenda.

 

CONSENT AGENDA

  • Approval of December 16, 2024, Regular City Council Meeting Minutes.

    ##AudienceThe Council will vote on approving the “minutes,” or official written record, from when it last convened on December 16, 2024. At this meeting, three teams that are part of the North Atlanta Football League – a youth football program affiliated with the cities of Milton and Alpharetta that plays out of Bell Memorial Park, Legacy Park, and North Park – were honored for the “Super Bowl” winning seasons. The Council also celebrated those who recently marked 5-year, 10-year, and 15-year milestones working for the City.   • Approval of the Financial Statements & Investment Report for the Period Ending November 30, 2024.

    This item is to approve the City of Milton government’s financial statements and investment report from November 2024.

     

  • Approval of a Change Order #3 to the Goods and Services Purchase Contract between the City of Milton and Utility Associates, Inc. for In-Car, Body Worn, and Interview Room Cameras for Transfer of Historical Digital Data to New Provider.

    This change order, if approved, will allow for the transfer of recorded digital video from Milton Police in-car, body worn, and interview room cameras from the previous provider to a new one, Axon.

    New Providence Road guardrail 

  • Approval of a Construction Services Agreement between the City of Milton and Gracie Gray Contractors, Inc. for Guardrail Repair Services at Multiple Locations in the City.

    With approval of this agreement, workers from Gracie Gray Contractors will install, repair, and maintain guardrails for bridges along Cogburn Road, Bethany Road, and New Providence Road.

     

  • Approval of a Services Agreement between the City of Milton and Maxair Mechanical, LLC for On-Call Plumbing Services.

    This is an agreement for professionals from Maxair to make repairs and provide other services as needed related to plumbing, septic, and water at City facilities, properties, and buildings. 

    Ebenezer 

  • Approval of an Intergovernmental Agreement between the City of Roswell and the City of Milton Regarding a Cross-Jurisdictional Road Improvement Project for Ebenezer Road Resurfacing.

    Ebenezer Road crosses the boundaries between the cities of Roswell and Milton several times. The City of Roswell is procuring a contractor’s services to repave this road (among others). Approval of this Intergovernmental Agreement, or IGA, would allow for the Roswell-hired contractor to pave the Milton portion of Ebenezer Road (in addition to the Roswell portion).

     

  • Approval of a Construction Services Agreement between the City of Milton and Enviro Masters, Inc. for Asbestos Remediation Services for the Structures Located at 2545 Bethany Bend and 990 Lackey Road.

    Milton plans to demolish two structures that are on City properties – one at 2545 Bethany Bend (which is adjacent to North Park) and the other 990 Lackey Road (which is the Lakhapani Preserve greenspace). This contract is for Enviro Masters experts to provide asbestos remediation services on these structures prior to their demolition.

     

  • Approval of an Agreement between the City of Milton and RapidScale, Inc. to Provide an Assessment and Migration Plan of On-Premises Server Environment to the Cropped rapidscale JPGMicrosoft Azure Government Cloud.

    With approval of this agreement, RapidScale will provide a migration plan and related services pertaining to the City of Milton’s plan to move digital data from physical, on-premises servers to the Microsoft Azure government cloud. The Microsoft Azure government cloud is a remote server with specific attributes and capabilities geared toward governments.

     

  • Approval of a Services Agreement with Stevens Gymnasiums, Inc. to Provide Basketball Court Refinishing at Mill Springs Academy, Northwestern Middle School and CampPic16Hopewell Middle School.

    Milton contracts with schools – specifically Mill Springs Academy, Northwestern Middle School, and Hopewell Middle School – so the City-affiliated youth basketball program run by Halftime Sports can play out of their gymnasiums. Part of that annual agreement is for the City to refinish these schools’ courts given the additional wear and tear related to the basketball program. This agenda item is for professionals from Stevens Gymnasiums to buff, clean, and apply polyurethane these gym floors. 

     

  • Approval of a Services Agreement between the City of Milton and All Termite and Pest Control, LLC (dba All Exterminating) for Pest, Termite, and Rodent Control Services.

    With this agreement’s approval, experts from All Exterminating will provide regular preventative pest, termite, and rodent control services at City-owned and operated facilities around Milton.

     

  • Approval of Subdivision Plats and Revisions.

    This minor plat revision would identify the two tracts that the developer of Braeburn Park plans to donate to the City of Milton for open space and right-of-way. One of the tracts is 0.08 acres while the other is 0.36 acres and located at 12780 Lecoma Trace, which is across that road from the City Hall parking lot/Community Place.

 

REPORTS AND PRESENTATIONS

  • Presentation Regarding Amicus Briefing in Chang v. City of Milton Appeal.

Lawyers are appealing a verdict in the Chang v. City of Milton case to the Georgia Supreme Court. (The Georgia Interlocal Risk Management Agency, the City of Milton’s insurer, is responsible for managing legal representation; GIRMA has retained Harold Melton, a former Chief Justice of the Georgia Supreme Court, and his Atlanta-based law firm, Troutman Pepper, for representation.). On Monday, Milton’s City Attorney will give a presentation regarding amicus briefs in support of Milton’s position in this case. FIRST PRESENTATION

  • Consideration of Text Amendment RZ24-04 to Article 7A Crabapple Form Based Code, Sec. 7A.1.6. Density Calculations of the Unified Development Code for the City of Milton Mural Parking lotMilton, Georgia as It Relates to the Number of Building Units and Parking Structures. 

    This proposed text amendment would apply only to the area covered by the Crabapple Form Based Code. It specifies that developers wishing to increase building units for each parking space within a parking structure must meet one of several criteria – rather than meet all the stated criteria – to do so. This would change the City policy back to what it had been for years prior to the 2024 adoption of the Unified Development Code (which states that all of the outlined criteria must be satisfied to allow for such increased density).

     

    NEW BUSINESS

  • Selection of the Mayor Pro Tempore.

    Historically, Milton’s Mayor and City Council selects a Mayor Pro Tempore (or Mayor Pro Tem) at the first meeting of every year – and, in accordance with that precedent, they plan to do so on Monday.

     

  • Consideration of a Resolution Appointing or Reappointing Members to the City of Milton Design Review Board by Appointing a Board Member for District 3/Post 1. 

Milton’s Design Review Board reviews new construction, new site development, and certain significant alterations to structures, as well as votes on demolition requests. This is a resolution to appoint a new member to the Design Review Board for District 3/Post 1.

 

  • Consideration and Approval of Final Order Granting Interpleader Relief and Directing Disbursement of Tax Sale Excess Funds on behalf of the City of Milton in Civil Action No. 24CV012735 for Property Located at 400 North Fields Pass in the amount of $2,211.03. The Petitioner is Patrick Labat, Fulton County Sheriff, versus Peach Perfection Solutions, LLC, North Fields Homeowners Association, Inc., City of Milton, and the Fulton County Tax Commissioner.

If the Council approves this Final Order, the City of Milton would receive approximately $2,211 in relation to delinquent taxes for a property at 400 North Fields Pass (which is at the intersection with Hopewell Road).
