BZA to consider multi-part variance request for Crabapple property

Arbor North angled bestMilton’s Board of Zoning Appeals is set to meet Tuesday to consider a multi-part variance request for a property in the Crabapple area.

The April 15 meeting will begin at 6 p.m. in City Hall’s Council Chambers. People can attend in-person or watch online at https://www.youtube.com/watch?v=xckFeuTVjeI.

Commonly referred to as BZA, the Board of Zoning Appeals is a quasi-judicial City committee that hears requests for variances from City Code (like those up for consideration Tuesday night) as well as appeals to City decisions related to the Unified Development Code, stream buffers, and sign buffers. All decisions made by this seven-member board are guided by City Code, including Milton’s zoning standards, and can be appealed to Fulton County Superior Court.

The Tuesday agenda is relatively light. After approving the “minutes,” or official written record, from its March meeting, the Board of Zoning will take up an item that Milton’s Design Review Board conducted a courtesy review on earlier this month.

It pertains to 315 North Court, which is in the Arbor North subdivision in Crabapple. The applicant is seeking variances to the City’s Unified Development Code to:

  • Reduce the 7-foot minimum side yard to 4.47 feet adjacent to the north property line for a proposed garage and shop addition
  • Reduce the 7-foot minimum side yard to 1 foot adjacent to the south property line for what remains of an existing shed accessory structure after its partial removal
  • Reduce the 50-foot minimum rear yard to 0.5-foot adjacent to the east property line for what remains of an existing shed accessory structure after its partial removal
  • Reduce the 50-foot minimum rear yard to 12.7 feet adjacent to the east property line for an existing covered grill and wet bar accessory structure
  • Reduce the 50-foot minimum rear yard to 11.1 feet adjacent to the east property line for an existing covered patio accessory structure

There are no other items on the agenda. After this week’s meeting, Milton’s Board of Zoning Appeals is next scheduled to convene on May 20.
