Chief to present Fire Dept. Annual Report to Council at June 2 meeting
Milton’s Fire Chief will share pivotal initiatives, accomplishments, and priorities documented in his department’s Annual Report at City Council’s next meeting on Monday night.
That presentation is one of several items on the agenda for the June 2 meeting, which will begin at 6 p.m. in City Hall’s Council Chambers (2006 Heritage Walk). People can attend in-person or watch online at https://www.youtube.com/watch?v=tcf67uA_2Dg.
As with any Regular Meeting, the agenda for this one is divided into sections that each have their own ground rules. They are:
- The CONSENT AGENDA, the home for routine items that the Council considers collectively (so one vote that covers everything on the Consent Agenda)
- REPORTS AND PRESENTATIONS, where you’ll find proclamations and presentations during which the Council can offer direction but cannot cast binding votes
- FIRST PRESENTATION, which is for certain types of items appearing on a Council agenda for the first time that cannot be voted on conclusively under a later meeting
- PUBLIC HEARING, a place that allows special opportunities for public comment for specific kinds of items
- ZONING AGENDA, which is the place for zoning-related items that appeared previously under First Presentation that can be decisively voted on
- UNFINISHED BUSINESS, another part of the agenda for items – except non-zoning ones –that were on earlier agendas under First Presentation
- NEW BUSINESS, which is where you’ll find items on a Council agenda for the first time that can be discussed and conclusively voted upon
Below are summaries of every item on Monday’s agenda.
CONSENT AGENDA
- Approval of the May 19, 2025, Regular City Council Meeting Minutes.
These are the “minutes,” or official written record, from when the City Council last convened on May 19. At this meeting, the Council approved a compromise conditional agreement granting a Use Permit for a “rural event facility” in and around a new 23,000-square foot building on the Arnold Mill Road campus of Ebenezer Methodist Church. The Council also voted in favor of two key measures – various City Code text amendments and a Design Manual – that can help guide the look, feel, and vitality of the Deerfield area. - Approval of the Financial Statements & Investment Report for the Period Ending April 30, 2025.
This item is for the Council to approve the City of Milton government’s financial statement and investment report from this past April.
- Approval of a Construction Services Agreement between the City of Milton and Prime Contractors, Inc. for the Exterior Weather Protection of the McConnell-Chadwick House.
The City earlier this year accepted the generous donation of the McConnell-Chadwick House – a structure built in the 1830s, making one of the oldest in present-day Milton as well as the region.
This historic one-story, Greek revival cottage home with a brick chimney and clapboard siding sits along Arnold Mill Road, near the Little River and Cherokee County line. Its first owner was Eli McConnell – a Brigadier General, State Senator (a role in which he proposed the creation of Milton County), owner of our area’s first flour mill, and designee by Gov. George Troup to sell former Cherokee property after the forced exodus of that Native American tribe’s members.
While long-term planning for this property continues, this agreement would authorize Prime Contractors to take more imminent steps to prevent water intrusion and deterioration from the elements. These measures should help maintain the current condition of the structure.
- Approval of a Recreation Provider Agreement Between the City of Milton and Halftime Sports, LLC to Provide Youth Basketball Programming.
This is an agreement for Halftime Sports to continue providing youth basketball programming through the City of Milton’s Parks and Recreation Department. Members of the Halftime team will lead camps, season-play, and tournaments out of several area gyms.
- Approval of a Construction Services Agreement between the City of Milton and 54 Faith, Inc. dba Five Star Painting for the Exterior Painting of the Thomas Byrd House.
The Thomas S. Byrd Sr. home – a 4,000-square foot, two-story structure that dates back to at least the mid-1800s – sits atop a hill on 2.5 acres by the roundabout at Hopewell and Birmingham roads. The City owns and maintains the property, which serves as home to the Milton Senior Center. With approval of this agreement, Five Star Painting would wash, repair, and paint the outside of the Byrd House as well as a four-board fence running parallel to Hopewell Road.
- Approval of a Recreation Provider Agreement Between the City of Milton and Hopewell Youth Association to Continue to Provide Youth Baseball Programming.
With approval of this agreement, Hopewell Youth Association – sometimes referred to as Hopewell Baseball – would continue providing youth baseball programming in Milton
in partnership with the City’s Parks and Recreation Department. Hopewell has operated a baseball program in Milton for decades, with practices, games, and tournaments now taking place at Bell Memorial Park, Legacy Park, Birmingham United Methodist Church, and various Fulton County School athletic fields.
- Approval of an Agreement between the City of Milton and Bounce House Inflatables of Atlanta LLC, dba Bounce House Atlanta Regarding Children’s Activities for Crabapple Fest 2025.
This is an agreement for Bounce House Atlanta to provide a fun, family-friendly package of games and activities during Crabapple Fest, annually Milton’s most well attended event that this year will occur on Saturday, October 4. The carnival games trailer, pirate ship ride, inflatable corn maze, bounces houses and slides will be set up that Saturday in a designated family area in downtown Milton referred to as the “Kids Zone.”
- Approval of Subdivision Plats & Revisions.
If approved by Council, these would:
+ Reconfigure the lot line between two parcels (collectively totaling 11.33 acres) along Magnolia Lane in The Homestead Milton subdivision off Hopewell Road
+ Split one plot along Birmingham Highway (between Taylor Road and Tullamore Way on the opposite side of the street) into two parcels of the same size (2.194 acres apiece)
REPORTS AND PRESENTATIONS
- Presentation of 2024 Fire Annual Report.
Every year the Milton Fire-Rescue Department produces an “Annual Report” to showcase the state of its organization, vital statistics, prominent programs, as well as other initiatives, developments, and highlights. Chief Gabe Benmoussa will share what’s in the latest report, which covers 2024, with the Mayor and City Council on Monday night. FIRST PRESENTATION
- Consideration of an Ordinance of the Mayor and Council of the City of Milton, Georgia, to Adopt Amendments to the Fiscal 2025 Budget for Each Fund of the City of Milton,
Georgia Amending the Amounts Shown in Each Budget as Expenditures, Amending the Several Items of Revenue Appropriations Including the Use of Additional Occupational Tax Revenue, Prohibiting Expenditures to Exceed Appropriations and Prohibiting Expenditures to Exceed Actual Funding Available.
As the City budget is a dynamic rather than static plan, it requires amending from time to time. The proposed budget amendments are an update to the Fiscal Year 2025 budget (which runs from October 1, 2024, to September 30, 2025). This Ordinance reflects recent changes recommended as a result of certain circumstances, opportunities, and recommendations. This same item must appear and be voted upon at a future City Council meeting to be enacted.
PUBLIC HEARING
- Discussion of an Ordinance of the Mayor and Council of the City of Milton, Georgia, to Adopt Amendments to the Fiscal 2025 Budget for Each Fund of the City of Milton, Georgia Amending the Amounts Shown in Each Budget as Expenditures, Amending the Several Items of Revenue Appropriations Including the Use of Additional Occupational Tax Revenue, Prohibiting Expenditures to Exceed Appropriations and Prohibiting Expenditures to Exceed Actual Funding Available.
This Public Hearing item – allowing a special opportunity for citizens to comment – relates to the same proposed FY2025 budget amendments described above in the “First Presentation” part of the agenda. There will be no corresponding vote taken at Monday’s meeting.
ZONING AGENDA
- Consideration of RZ25-05 - Article 8 Use Provisions, Sec. 8.2.1 Use Table for All Districts Except Form Based Codes Regarding Assembly Hall, Event Facility to the Unified Development Code for the City of Milton, Georgia.
With approval of this item – which appeared under First Presentation on the Council’s May 19 agenda – the Unified Development Code would be amended to specify that Use Permits would be required for assembly halls/event facilities in all districts including those covered under Form-Based Codes (in Deerfield and Crabapple). Currently, assembly halls/event facilities are allowed “by right” (meaning a Use Permit isn’t needed) on properties zoned C-1 (Community Business) and MIX (Mixed Use). The Planning Commission unanimously recommended approval of this item at its April 23 meeting.
- Consideration of RZ25-06 - Article 2 General Provisions, Article 6 Special Purpose Districts, Article 7A Crabapple Form Based Code, Article 7B Deerfield Form Based Code, and Article 9 Site Development Regarding Stormwater Facilities to Correct References within the Above Articles to the Unified Development Code for the City of Milton, Georgia.
This proposed text amendment, if approved, would ensure that references to the design and development of stormwater facilities are consistent throughout Milton’s Unified Development Code, including for various Overlays and Form-Based Code areas. This is essentially a housekeeping matter, with no substantive revisions to meaning or intent. This same item appeared under First Presentation at the Council’s most recent meeting on May 19, so it can be voted on conclusively Monday night. As with the previous “Assembly Hall” item, Milton’s Planning Commission unanimously recommended approval of this item at its April 23 meeting.
UNFINISHED BUSINESS
- Consideration of an Ordinance to Modify the Council's Internal Rules of Procedure to Remove Language Prohibiting Official Action During the Public Hearing Agenda.
The “Public Hearing” section of a City Council agenda allows community members to attend and participate in public comment, where all discussion and deliberation take place. However, formal action is then delayed until the New Business portion of the meeting—an inefficient process with no legal necessity.
If this item (which appeared under First Presentation on the May 19 Council agenda) is approved, this ordinance change would allow the Council to take votes or make decisions during the public hearing item itself. The goal is to streamline proceedings while still ensuring the public’s input is heard and considered in real time.
NEW BUSINESS
Consideration of a Resolution to Condemn Property Rights Needed for Webb Road at Cogburn Road Left Turn Lane and Widening Project (Project No. N/A), Parcel 01; 0.029 Acres of Fee Simple Right of Way; 332.12 Square Feet of Temporary Easement for Construction of Slopes (tract 1); and 2,945.15 Square Feet of Temporary Easement for Construction of Slopes (tract 2). Owner: Fulton Greens Limited Partnership.
The City plans to make several transportation improvements in the area around Webb Road and Cogburn Road, including widening and adding a left turn lane. Acquiring small sections of land for right-of-way and easement are necessary for this project to proceed. This resolution would allow the City to obtain needed land by condemnation.
Meanwhile, City staff will continue to negotiate with the parcels’ owner, doing everything possible to reach an agreement and avoid litigation. However and whenever the matter is resolved, approval of this item would allow the City to move forward with improvements to this intersection.
