Board of Zoning Appeals to consider a pair of variance requests

The Board of Zoning Appeals, or BZA, is a quasi-judicial body that hears appeals to City decisions related to zoning ordinances, stream buffers, and sign permits. Its members’ votes are guided by City Code, including its zoning standards. This committee’s decisions can be appealed to Fulton County Superior Court.

BZA is part of the City’s public hearing process, meaning other committees consider some of the same items. For instance, two of those that will be taken up Tuesday – both of them primary variance requests – came before the Design Review Board earlier this month.

The first relates to 13805 Hopewell Road, a 1.035-acre property located across from Bethany Way. The applicant sought a variance to increase the maximum lot coverage from 20 percent to 23.86 percent to allow for a proposed single-family home with an oval turnaround driveway, a pool, and pool decking. After feedback from the DRB, the applicant reduced their variance request to 21.69 percent lot coverage with a revised site plan submitted to City Staff on November 7. 

The other request for a primary variance from an element of the City’s Unified Development Code pertains to 12555 Sibley Lane in southwestern Milton’s Sweet Apple area, near State Route 140/Arnold Mill Road. This variance, if granted, would reduce the minimum rear-yard setback requirement from 50 feet to 25.79 feet for a covered patio accessory structure – specifically, a pool cabana.   

The lone other item on Tuesday’s agenda is setting the Board of Zoning Appeals’ calendar of meetings for 2026.
