Milton’s Board of Zoning Appeals on Tuesday night will consider a pair of primary variance applications, one involving five requests.

Referred to as BZA, the Board of Zoning Appeals is a quasi-judicial body that hears appeals to City decisions related to Milton’s Unified Development Code, stream buffers, and sign permits. Its seven appointed members also vote on variance requests, like those set to be taken up Tuesday. The Unified Development Code guides its decisions, which can be appealed to Fulton County Superior Court.
Tuesday’s first substantive agenda item a five-part variances request for 14115 Brittle Road, a 1.58-acre lot at the corner with Redd Road. The applicant is requesting to:
- Reduce the 25-foot minimum (interior) side-yard minimum setback to 10 feet adjacent to the east property line for a proposed guest house
- Reduce the 40-foot minimum side-yard (street) setback to 27.96 feet adjacent to the west property line and Brittle Road for a proposed guest house
- Reduce the 25-foot minimum side-yard (interior) setback to 10 feet adjacent to east property line – in this case for a proposed primary single-family home
- Reduce the 50-foot minimum rear-yard setback to 42.33 feet adjacent to south property line for a proposed carport accessory structure
- Allow a proposed guest house to be located in front of a proposed single-family home
This will be followed by the consideration of a request from the owner of 2215 Dinsmore Road, a 2.17-acre property west of Thompson Road. BZA will consider the applicant’s request – citing a steep grade on part of their lot – to reduce the 25-foot minimum side-yard setback to 10.5 feet adjacent to the west property line for a new garage (with Nellie Stevens shrubs proposed to be added for screening).
After Tuesday, the Board of Zoning Appeals next meeting is scheduled for June 16.
