Council set to vote on another extension of data center moratorium

As is customary, the agenda for this Regular Meeting is divided into sections that have their own ground rules. In this case, they are:

  • The CONSENT AGENDA, for routine items that are considered collectively (so a single yes-no vote that covers the entire Consent Agenda)
  • REPORTS AND PRESENTATIONS, which is where you will find proclamations and presentations, during which the Council may listen, ask questions, and offer general direction but cannot cast votes
  • PUBLIC HEARING, which allows for a special public comment period for certain types of items
  • NEW BUSINESS, the home for items appearing on a Council agenda for the first time that can be discussed and conclusively voted upon

Below are summaries of the items on the July 20 agenda.

 

CONSENT AGENDA

  • Approval of the July 6, 2026, Regular City Council Meeting Minutes.

The Council will vote on approving the “minutes,” or official written record, from when they last convened on July 6. At this meeting, Council participated in a constructive, vital discussion about Milton’s upcoming Comprehensive Plan Update, with a special focus on the future of Deerfield. City staff also made their first presentation about the proposed Fiscal Year 2027 budget, including hiring a new GIS Technician and making improvements to several fire stations.   • Approval of the Financial Statements and Investment Report for the Period Ending April 30, 2026.

Morris Road concreteThis item is to approve the City of Milton government’s financial statement and investment report from this past April.

 

  • Approval of Task Order #3 with LJA Engineering, Inc for Construction Engineering and Inspection (CEI) at the Morris Road Widening Project.

    With approval of this task order, LJA Engineering would continue working with the City on the Morris Road widening-plus project. This will ensure continued construction oversight, quality control, contract administration, and project delivery by LJA professionals in close coordination with the City.

    The project calls for the widening of Morris Road from the existing Webb Road roundabout to McGinnis Ferry Road, where the Georgia Department of Transportation (GDOT) recently opened the new State Route 400 interchange. Changes to intersections at the Bethany Bend and the Webb Road roundabout, the creation of a new landscaped median, new 10-foot-wide multi-use path, stormwater improvements, and added 5-foot-wide sidewalk are part of its scope as well.   • Approval of a Professional Services Agreement with Hatley Plans LLC for the 2026 Capital Improvements Element (CIE) Annual Update of the City's Development Impact Fee Program.

    The State requires that City governments annually adopt a Capital Improvement Element Annual Update in order to collect impact fees. Impact fees are collected from new development and help fund eligible capital improvements needed to serve growth, including roads, bridges, parks, and public facilities.

    This item refers to an agreement with Hatley Plans (as it has done in the past) to work with City staff to produce such an update. The City Council will review Green Arnold Millthat document, after which it must be submitted to the Atlanta Regional Commission and State of Georgia Department of Community Affairs for review and approval.

     

  • Approval of an Intergovernmental Agreement between the City of Milton and the City of Alpharetta Regarding Land Acquisition for the SR 140/Arnold Mill Road at Green Road Intersection Improvement Project.

    The City of Milton is undertaking a project improve safety and efficiency at the intersection of Green Road and State Route 140/Arnold Mill Road in coordination with the Georgia Department of Transportation. This will require the acquisition for parts of 11 parcels, one of which falls within Alpharetta city limits. This proposed Intergovernmental Agreement authorizes Milton to acquire the necessary right-of-way outside its own city limits in Alpharetta for this TSPLOST-funded project to proceed.

     

  • Approval of Subdivision Plats and Revisions.

    This item pertains to a request to divide a 2.93-acre parcel at 14750 Hopewell Road, which is by the Cogburn/Francis/Hopewell roundabout, into two separate lots of 1.51 and 1.42 acres.

    REPORTS AND PRESENTATIONS

  • Recognition of Appreciation to Nan Buckner for Service on the Milton Equestrian Committee.

    As a farm owner, businesswoman, and engaged Milton resident, Nan Buckner has devoted many hours over many years to being part and serving our local equestrian community. This includes considerable time as a dedicated, contributing member of the Milton Equestrian Committee before she stepped down earlier this year.

    On Monday night, the City Council will formally recognize Buckner’s valuable service while expressing appreciation all that she has done for Milton and our equestrian community in particular.  

     

  • Presentation of Fulton County's New Behavioral Health and Human Services facility in the North Fulton Area.

    Earlier this year, Fulton County opened its new Health and Human Services – North facility in Alpharetta off North Point Parkway. This furthers the County’s Fulton County Health Services dooraim to increase and make more easily accessible health and human services care, support, and resources for those who live in North Fulton, including in Milton. The building is home to:

  • Fulton County Board of Health offerings (including children’s dental, WIC, nursing, and women’s health)
  • Behavioral Health and Developmental Disabilities services (for adults, children, and adolescents)
  • Senior Services (including a Senior Center and adult day health program)
  • Recovery Treatment Court (including group therapy, substance abuse testing, and program meetings for those enrolled in the Recovery Treatment Court program)
  • Customer Service Support (with complaint monitoring and resolution, translation, accessibility support, and general inquiries)

    At Monday’s Council meeting, Fulton County health officials will share information about this new facility and explain how it serves residents in Milton and beyond.  

     

  • FY 2027 Budget Discussion and Feedback.

    At the last Council meeting, City staff gave an overview of the process to create the Fiscal Year 2027 budget (which will run from October 1, 2026, through September 30, 2027) as well as detailed new proposed initiatives and capital requests. This Monday’s presentation continues that budget discussion, just with a slightly different focus.

    Deputy City Manager Bernadette Harvill will share a five-year operating forecast of the City finances as they relate to both revenues and expenditures. She also will welcome Council feedback going forward, just like she did at the previous meeting and will at a future one. The Council will not vote on adopting the City’s next budget until mid-September.

     

    PUBLIC HEARING

  • Consideration of the Issuance of an Alcohol Beverage License to Culinary Management of America dba Gracious Gatherings, 12900 Arnold Mill Road, Roswell, Georgia 30075 (located within Milton City limits). PUBLIC HEARING CANCELED - Staff directed removal due to application issue

     

  • Consideration of a Resolution of the City of Milton, Georgia Extending for up to One Hundred and Eighty (180) Days a Moratorium Barring the Acceptance of Applications for Rezoning, Land Disturbance Permits, Building Permits, Special Use or Conditional Use Permits, Business Licenses, Certificates of Occupancy, or Other Permits for the Placement, Siting, Construction, Establishment, Expansion, or Operation of Data Centers Such As Will Allow the City To Consider Amendments to the City of Milton's Unified Development Code; and For Other Lawful Purposes.

    Data centers represent a unique and increasingly common form of development throughout Georgia, including metropolitan Atlanta. While data centers support modern technology and communications infrastructure, they can also create significant impacts related to utility demand, infrastructure capacity, noise, lighting, emergency response, traffic, aesthetics, environmental considerations, and compatibility with surrounding land uses.

    Milton’s City Council adopted a temporary moratorium on data center-related applications at its June 15 meeting. They voted for a shorter extension on July 6 to allow sufficient time to satisfy public notice requirements and conduct a public hearing regarding a longer extension.

    On Monday, such a public hearing will be held and a vote taken to potentially extend the moratorium up to 180 days on the same terms. This will give the City time to evaluate existing regulations, develop potential amendments, receive stakeholder input, and present recommendations to Council regarding the future regulation of data centers within Milton.

     

    NEW BUSINESS

  • Consideration of Final Plat Revision - Bridlefield

Previously, the City Council approved the final plat for Bridlefield – a new subdivision that is split between Milton, Forsyth County, and Cherokee County. The approved Milton portion has 22 single-family residential lots spread over 45.46 acres.

The final plat revision would not alter the number of overall lots, nor the overall acreage. The only changes would be to incorporate column easements for two lots, as well as add the water bill of material list to the cover sheet.
